Health and Safety Overview

Our Health and Safety Group advises on compliance and defence of prosecutions and works closely with businesses to help them deal with the impact of an accident in the workplace. European and Irish health and safety legislation is under constant revision, and we help our clients to manage this changing landscape, in relation to their employees and to their contractual obligations with others. This is particularly relevant to construction projects, and McCann FitzGerald has close links with all of the key stakeholders in the industry including the Construction Industry Federation and the various consultants’ bodies as regards health and safety.

Our work

Although our specialists' experience is more commonly called upon in construction (simply due to the nature of the industry), we have experience across all sectors, including:

In each of these industry sectors, we provide advice to businesses regarding their statutory obligations to employees and to members of the public. We also act on behalf of clients in defending criminal prosecutions or other forms of enforcement action taken by the Health and Safety Authority, or the Director of Public Prosecutions. This role involves not just defence of the criminal prosecution but also assistance during the investigatory stages following an incident, as well as before and during interviews under caution.
